Bild Brands
Privacy Policy

Last updated: February 8, 2025

Introduction

Bild Brands LLC (“we“, “us“, or “our“) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you interact with our services (collectively, the “Services“), including our websites, mobile applications, and online community platforms. We have drafted this Policy to be clear and easy to navigate, with sections addressing specific topics for your convenience.

We aim to comply with all applicable privacy laws and regulations in the regions where we operate. However, this Policy is a general privacy statement and is not tailored to any single law (such as GDPR or CCPA). Instead, it outlines broad principles to protect your data and privacy rights. We also design this Policy to be flexible, so it can be updated as our Services or legal requirements evolve without requiring a complete overhaul.

By using our Services, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree with our practices, please refrain from using our Services. If you have any questions or concerns about this Policy, you can contact us using the information provided at the end of this document.

Information We Collect

We collect several types of information from and about users of our Services. The amount and type of information collected depend on how you interact with us. Generally, we collect information in three ways: (1) information you provide to us directly, (2) information we collect automatically, and (3) information we obtain from third parties.

1. Information You Provide to Us

You may provide personal information to us when you:

  • Create an Account or Profile: When you register for our Services (for example, by joining our online community or signing up on our app), you may give us information like your name, email address, phone number, mailing address, username, password, and other registration details.

  • Communicate with Us: If you contact us with inquiries, support requests, or feedback (via email, contact forms, or phone), you may provide your name, contact information, and the content of your communication.

  • Transactions and Purchases: If our Services involve purchases or subscriptions, you might provide payment information (such as credit card number or payment account details). Note: We use secure third-party payment processors to handle payment data; we generally do not store your full financial information on our systems.

  • Surveys, Promotions, and Events: You may also provide information when responding to surveys, entering promotions, or signing up for events related to Bild Brands. This could include your opinions, preferences, and any other information you choose to share with us.

  • Content You Share: If you post or upload content on our community platform or via our Services (for example, profile information, comments, photos, or other media), we will collect whatever information you include as part of that content. This can also include metadata associated with the content (like the time a photo was taken).

2. Information We Collect Automatically

When you use our Services, we automatically collect certain information about your device and usage of the Services:

  • Device and Technical Information: We receive details about the device and software you use to access our Services. This may include your IP address, browser type, operating system, device model, unique device identifiers, and device language settings. If you use our mobile application or community platform, we also collect mobile-specific identifiers and settings (such as your device’s operating system and version).

  • Usage Data: We track how you interact with our Services. This includes the pages or screens you view, the features you use, the dates and times of your visits, the links you click, and other actions you take. We may log the referring webpage that led you to our website and the page you visit after our site. This usage data helps us understand and improve user experience.

  • Cookies and Similar Technologies: Like most online services, we use cookies, pixels, and similar tracking technologies to remember your preferences and recognize you across different services. These technologies collect information about your browsing actions and patterns. You can control cookies through your browser settings and other tools; however, disabling cookies may affect certain features of our Services.

  • Location Data: If you use our mobile app or certain features of our community platform, we may collect information about your location. For example, our mobile application or the platform (such as those provided by Mighty Networks or Circle) might access your device’s geolocation to provide location-based services or content — but only if you have given permission for us to do so. We may derive your general location from your IP address or collect precise location (GPS coordinates) if you opt-in via your device settings.

  • Mobile App Data (Mighty Networks and Circle): When you use our mobile application or participate in our online community hosted on third-party platforms like Mighty Networks or Circle, those platforms collect certain data on our behalf. This data can include:

    • Device Information: Information about your mobile device such as device type (e.g., phone or tablet), operating system and version, unique device IDs, and mobile network information.
    • App Usage Information: Data about how you use and navigate our app or community, including the content you view or engage with, and the time spent in different sections.
    • Push Notification Preferences: If you enable push notifications, we record your preference to receive push notifications and may collect a device token or identifier to send these messages. (You can always adjust your push notification preferences in your device or app settings.)
    • Location (App-specific): As noted above, the app/platform may collect your precise location if you allow it. This can enable features like location-based content or services. You can control this by granting or revoking location permission via your device’s settings at any time.
  • Log Files: Our servers automatically record certain information in log files, including your IP address, browser type, internet service provider, referring/exit pages, operating system, date/time stamps, and clickstream data. These logs are used for troubleshooting, security monitoring, and analyzing trends.

3. Information We Obtain from Third Parties

On occasion, we may receive information about you from third-party sources:

  • Social Media and Single Sign-On: If you choose to register or log into our Services through a third-party account (such as Google, Facebook, or other social media platforms), we may receive information from that third party such as your name, email, and public profile information. We will handle that information in accordance with this Policy.

  • Business Partners and Referrals: We might receive your information from our marketing partners, affiliates, or if someone refers you to our Services. For example, if you are referred to our Service via a partner, they may send us your name and contact details.

  • Public Sources: We may also collect information made publicly available (for example, information you submit in public forums, social media profiles set to public, or information in professional databases) and use it to supplement our records and improve our Services.

  • Third-Party Data Providers: In some cases, we might obtain supplemental information to better personalize your experience (such as demographic or interest data) from third-party data providers. We only do this where those providers have the legal right to share such data with us.

Please note that any information we receive from third-party sources will be combined with information we collect directly, and we will treat the combined information under the same protections of this Privacy Policy.

Sensitive Personal Information

We understand that certain personal information is considered sensitive and may receive special protections under law. This can include data about your health, genetic or biometric data, racial or ethnic origin, religious or philosophical beliefs, union membership, sexual orientation, or precise geolocation, among others. In general, we do not actively seek to collect sensitive personal information about our users. However, in the event that we do process sensitive personal data, we will only do so when necessary and with appropriate safeguards — for example, with your explicit consent or where required by applicable regulations (Privacy Statement – Moderna).

If you voluntarily provide us with any sensitive information (for instance, by including it in content you post on our platform or in communications with us), we will treat it as confidential and will only process it for the limited purposes necessary for providing the service you requested or as otherwise permitted by law. We will not disclose sensitive personal information to third parties without your consent, except where we are legally compelled to do so or it is necessary to protect your vital interests. By recognizing the sensitive nature of such data, we commit to handling it in compliance with all relevant regulations and with the highest care for your privacy.

How We Use Your Information

We use the personal information we collect for various legitimate business purposes. The primary purposes for which we process your information include:

  • To Provide and Maintain Services: We use your information to create and manage your accounts, allow you to log in, and enable you to use our websites, apps, and community features. This includes processing transactions you request, such as memberships or purchases, and providing customer support.

  • To Personalize Your Experience: Information about you helps us customize content and recommendations. For example, we might use your past interactions to suggest relevant articles, or use your location to tailor content that is applicable to your region.

  • To Communicate with You: We may send service-related communications (such as confirmations, invoices, technical notices, updates, security alerts), or respond to your inquiries. We also send promotional communications to inform you about new features, offers, or events we think you’d be interested in. (You can opt out of marketing emails as noted in the Your Rights and Choices section below.)

  • For Analytics and Service Improvement: We analyze usage data and feedback to understand how our Services are used. This helps us troubleshoot issues, develop new features, enhance usability, and improve the quality of our Services. For example, usage patterns might inform us which features are popular or if any user interface areas are causing confusion.

  • To Ensure Security and Prevent Fraud: Your information is used to maintain the security of our platforms. We monitor activities to detect and prevent fraudulent transactions, spam, abuse, security incidents, and other harmful or illegal activities. This may include verifying accounts, investigating suspicious activity, and enforcing our terms and policies.

  • To Comply with Legal Obligations: We may process your personal data to comply with applicable legal requirements, such as responding to lawful requests by public authorities, adhering to record-keeping obligations, or fulfilling obligations related to consumer rights requests. If necessary, we will use your information to protect our rights and the rights of our users or others (for example, in legal disputes or to enforce our agreements).

  • With Your Consent: If we ever process your information for a purpose that requires consent under applicable law (for instance, if we want to use your testimonial on our website or process certain sensitive data), we will ask for your consent. Where you have given consent, you have the right to withdraw it at any time, as described below.

  • Other Purposes: We may use your information for other operational purposes, which we will describe to you at the time of collection or prior to using the data. We will ensure any new use is compatible with the purposes for which we originally collected your data or otherwise permitted by law.

We ensure that we have a valid legal basis for processing your personal information. These bases include the necessity to perform a contract (providing the Services to you), our legitimate business interests (improving our Services, securing our platform, marketing to customers), compliance with a legal obligation, and in some cases, your consent.

How We Share Your Information

We do not sell your personal information. However, we may share or disclose the information we collect in the following circumstances:

  • With Service Providers and Partners: We share data with trusted third-party companies that perform services on our behalf. These include companies that assist us with operations such as web hosting, cloud storage, data analytics, payment processing, customer support, email delivery, marketing, and community platform services. They are authorized to use your information only as necessary to provide these services to us.

  • Within Our Corporate Group: If Bild Brands LLC has affiliates, subsidiaries, or related companies (for example, if we have multiple companies under common ownership), we may share information within that corporate group. This is done to streamline operations, improve services, and provide a seamless experience across our offerings. Any affiliated entities are bound to protect your information in accordance with this Policy.

  • For Legal Compliance and Protection: We will disclose your information if required to do so by law or legal process, or if we have a good-faith belief that such action is necessary to (a) comply with applicable laws or respond to valid legal requests (e.g., a subpoena, court order, or government demand), (b) protect and defend our rights or property, (c) prevent or investigate possible wrongdoing in connection with the Services, such as suspected fraud or security issues, or (d) protect the safety of our users, employees, or the public as required or permitted by law.

  • Business Transfers: In the event of a corporate transaction such as a merger, acquisition, reorganization, sale of assets, or in the unlikely event of bankruptcy, user information may be transferred to a successor or affiliate as part of that transaction. If such a transfer occurs, your personal information would remain subject to the promises made in this Privacy Policy (unless you consent otherwise).

  • With Your Consent or at Your Direction: We may share your personal information with third parties if you request or direct us to do so. For instance, if you choose to integrate our Service with a third-party platform, or use a feature that requires sharing data with another service, we will do so with your consent. Additionally, we might share testimonials or user content with your permission.

  • Aggregated or De-Identified Data: We may share information that has been aggregated (combined with other data so it no longer identifies you personally) or fully de-identified (stripped of personal identifiers) with third parties. This information cannot be linked back to you and is used for purposes such as industry research, analysis, marketing, and advertising.

Rest assured, when we share information with any third party, we take steps to ensure they uphold strong privacy and security standards. We only share the minimum amount of information necessary for them to perform their specific services.

Third-Party Service Providers

We rely on a number of third-party services to operate and enhance our Services. These third-party service providers may process personal information on our behalf as part of the services they offer. To maintain broad compliance and flexibility, we list categories of providers and examples (which may be updated over time):

  • Cloud Storage and File Management: We use cloud storage solutions (such as Dropbox) to securely store and manage files, backups, and data related to our business. These providers may process files that include personal information as part of providing cloud-based storage and syncing capabilities.

  • Communication and Collaboration Tools: Our team utilizes third-party tools like Slack for internal communication and collaboration. In some cases, this may involve processing of user information (for example, discussing a client project or sharing your contact info internally to assist you). All such use is internal to our organization for the purpose of serving you.

  • Artificial Intelligence and Analytics Platforms: We may use AI platforms and analytics services to help us understand data patterns or deliver smart features. For instance, we might employ machine learning services to analyze feedback or usage data, or AI-driven tools to provide personalized content. These platforms process certain data (which may include personal information or usage data) strictly under our instruction to improve the Services or provide specific functionalities.

  • Community and Membership Platforms: We host our community and membership services on third-party platforms such as Mighty Networks and Circle. If you join our community or use our mobile application provided through these platforms, your information (e.g., profile data, posts, and engagement within the community) is processed by those platform providers on our behalf. They enable features like user profiles, forums, messaging, event management, and notifications for our community.

  • Other Service Providers: In addition to the above, we use various other third parties to support our operations. This includes email service providers (for sending newsletters or service emails), marketing and advertising partners, customer relationship management (CRM) systems, scheduling and project management tools, and payment processors (if you conduct transactions). For example, we might use an email platform to send updates, or a payment gateway to process any fees or purchases. These providers only receive the information necessary to perform their functions and are contractually obligated to protect your data and use it only for the agreed-upon purpose.

We take care to engage third parties that have strong privacy and security practices. Prior to sharing any personal data, we ensure that appropriate agreements (such as Data Processing Addendums) are in place to require that your data is handled in compliance with applicable privacy laws. Our use of third-party services is designed to be adaptable — meaning if we add, remove, or change service providers in the future, we will update our internal list and ensure continued protection of your information, without needing to materially change this Privacy Policy each time.

Please note that third-party providers may have their own privacy policies that apply to their handling of your data. We encourage you to review the privacy notices of any third-party services you interact with. However, our agreements with them limit how they can use your data in the context of the services they perform for us. We remain responsible for the protection of your personal information when it is processed by our service providers on our behalf (Fortanix Privacy Policy | Fortanix).

Data Retention

We retain your personal information for as long as it is necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In general, this means we will keep your data for the duration of your relationship with us and for any period thereafter as needed for legitimate business purposes. By default, we retain customer data indefinitely for as long as your account is active or as necessary to provide you with our Services (Privacy Statement | Entomological Society of America). This approach allows us to maintain continuity in our services to you, such as preserving your account history, preferences, and any content you have provided, unless you decide to remove it.

If you wish to have your personal data deleted, you have the right to make such a request (see the Your Rights and Choices section below for more on how to do this). Upon receiving a verified deletion request, we will delete or anonymize your personal information from our active systems. However, please note that in some cases we may need to retain certain information for a limited time longer to: (a) comply with legal or regulatory obligations (for example, maintaining transaction records for financial auditing or tax purposes), (b) resolve disputes or enforce our agreements, or (c) detect and prevent fraud or abuse. In such cases, we will retain only the data necessary for the specific purpose and for the period required by law or strictly necessary for our legitimate interests (Privacy Statement | Entomological Society of America).

Even after you delete your account or we purge your data, residual copies may remain in our backup or archival systems for a brief period (due to the nature of backup processes), but we will continue to protect such information and securely delete it in the normal course of our data retention cycles.

Our data retention practices are designed to be flexible to accommodate changes in legal requirements and our business needs. We periodically review the data we hold and anonymize or delete information that is no longer needed for any legitimate purpose.

Data Security

We take the security of your personal information seriously. Bild Brands LLC implements a combination of administrative, technical, and physical security measures designed to protect your data from unauthorized access, disclosure, or alteration. These measures include access controls limiting who within our organization can access information, the use of encryption and secure protocols to protect data during transmission, and firewalls and monitoring to guard against external threats.

While we strive to protect your information, it’s important to note that no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security of your data. In particular, no method of transmitting or storing data can be guaranteed to be 100% secure or hacker-proof (Privacy Policy – Affect Group). You should use caution when sharing information online and understand that there is some risk inherent in transmitting information over the internet.

We encourage you to help us keep your information safe as well. Choose a strong password for any account and do not share it. If you suspect any unauthorized access to your account or any security vulnerabilities, please notify us immediately so we can take appropriate measures.

In the unfortunate event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law, and we will take immediate steps to mitigate the breach and prevent future incidents.

Your Rights and Choices

You have certain rights regarding your personal information, and we offer various choices about what information you provide to us, how we use it, and how we communicate with you. We are committed to respecting your rights and helping you exercise them. These rights and options include:

  • Access and Correction: You have the right to request access to the personal information we hold about you and to receive a copy of it. You also have the right to request that we correct or update any information that is inaccurate or out of date (Privacy Policy – Child and Family Guidance Center). We will provide you with your data and make corrections upon verification of your identity (to protect your privacy and security).

  • Deletion (Right to Erasure): You can ask us to delete your personal information. Upon your request (or when required by law), we will delete your data from our active databases, unless retaining the information is necessary for us to comply with legal obligations or exercise or defend legal claims (Privacy Statement | Entomological Society of America). Please note that if you request deletion of necessary data, this may result in the closure of your account or the inability for us to provide you certain Services.

  • Withdrawal of Consent: If we are processing any of your personal information based on your consent (for example, if you gave consent to receive marketing emails or to share precise location data), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, and it may take a short time for your withdrawal to be fully implemented.

  • Opting Out of Marketing Communications: If you receive promotional emails or newsletters from us, you can opt out at any time by clicking the “unsubscribe” link in those emails or by contacting us directly with your request. Even after you opt out of marketing messages, we may still send you transactional or service-related communications (such as account notifications or responses to your inquiries) as those are not promotional in nature.

  • Push Notifications and Location Sharing: If you previously consented to push notifications or location sharing through our mobile app or community platform, you can adjust your choices at any time in your device settings. You can disable push notifications or revoke location permissions, which will limit those features from operating.

  • Cookies and Tracking Technologies: As mentioned, you can control or delete cookies through your browser settings. You can also use browser extensions or settings to block certain trackers. However, doing so might affect functionality of our website. We do not currently respond to “Do Not Track” signals, but we treat the data we collect via cookies with the same care as any other personal data.

  • Non-Discrimination: We will not discriminate against you for exercising any of these privacy rights. That means, if you make a privacy request, we will not deny you our Services, provide a different level of service, or charge you a different price (except as permitted by law, for example if your request results in a service that is less tailored and thus may have a different value).

To exercise any of your rights, please contact us using the information in the Contact Us section below. For certain requests, we may need to verify your identity to ensure we’re providing access to or modifying information for the correct person. We will respond to valid requests within the timeframe required by applicable law. Keep in mind that these rights are subject to some conditions and exceptions under applicable laws; in such cases, we will explain to you why we may not be able to fulfill a part of your request (for example, if fulfilling a deletion request would undermine a legal obligation we have).

Children’s Privacy

Our Services are not directed to individuals under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not register on our site or app, make purchases, or send us any personal information. In the event we learn that we have inadvertently collected personal data from a child under 13, we will take immediate steps to delete that information from our records (Privacy Policy – Great Kids, Inc.).

If you are a parent or guardian and you believe that your child under 13 has provided us with personal information, please contact us. We will work to delete the data as soon as possible and take any other appropriate measures. For teens older than 13 but under the age of majority in their jurisdiction, we recommend that they seek permission from a parent or guardian before using our Services or providing any personal information.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, and other factors. We reserve the right to modify this Policy at any time, in our sole discretion. If we make material changes, we will notify you by (for example) posting a prominent notice on our website or sending an in-app notification or email, and by updating the “last updated” date at the top of this Policy.

Any changes to this Policy will become effective when the revised Privacy Policy is posted on our website or otherwise made accessible to you. In some cases, we may notify you in advance, especially if we plan to process your personal information for a new purpose not originally outlined. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.

By continuing to use our Services after any changes come into effect, you will be deemed to have accepted the updated Policy. If you do not agree to any updates, you should stop using our Services and can request that we delete your personal information.

(In summary: We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons (Privacy Policy – Gastroenterologists of Ocean County).)
